Renter has full access to the well kept fenced yard and garden, and is invited to do as much or as little gardening as they'd like. Apartment also has its own little patio with two Adirondack chairs. Primary access to the apartment is from the front, through the secured garden gate, to a sliding glass door. Your upstairs neighbor (he's also the home owner) is a retired professional who keeps mostly to himself and travels frequently.
