No Subletting Boarders, Lodgers, Airbnb: No subletting the apartment. No boarders or additional occupants will be allowed to reside in the apartment without the express permission of the Landlord. Cannabis: Lessee and any other persons at the premises are prohibited from growing, cultivating, manufacturing, producing, processing, distributing, marketing, or selling cannabis plants or any part thereof (including, without limitation, marijuana), marijuana derivatives, marijuana limitations, or any items containing tetrahydrocannabinol ("THC"). Any violation by Lessee of this Section shall be deemed a failure to comply with the provisions of this Lease and may subject Lessee to a fine of $100.00 and shall entitle Lessor to pursue all available remedies. A single violation of any of the provisions of this Section shall be deemed a serious violation and a material default of the Lease, which shall be cause for Lessor's termination of Lessee' s tenancy. 34. Pest Control: Pest control can only be achieved by cooperation between landlord and residents. The following will help in controlling pests, and the tenant's obligation to perform; Do not leave food open Do not leave dirty dishes overnight Have your trash barrel closed at all times Do not store old newspapers Lessor will be responsible for rodent extermination except for in the event that uncleanliness in the premises caused by the residents is deemed by an exterminator to be the cause for the rodent infestation. Lessor shall provide one notice to the residents to keep premises clean. If, following the notice, the residents do not maintain the required cleanliness in order for the exterminator to do effective treatment, the Lessor shall have the right to hire a professional cleaning company to clean the premises on a regular basis at the expense of the Lessee, and/or the Lessee shall be responsible for payment of all further extermination required due to unclean conditions. 36. Tenant Possession After Expiration Lease Date: If Lessee remains in possession of the premises beyond the expiration of the term without Lessor's prior written consent, then Lessee shall be deemed a tenant at sufferance and shall pay to Lessor an amount equal to 150% of the rent being paid to Lessor during the term of the Lease, calculated on a daily basis for each day of holding over, as well as Lessor's cost of recovering such sum, including reasonable attorney's fees. Lessee's obligations in this section shall survive the termination of the Lease. 37. Start Lease Date/Time: Lease starts at 2:00 pm on the __________ day of the Lease Term and terminates at 11:00 am on the last day of the term. Tenants shall be liable to Landlord for any violations issued to Landlord as a result of Tenant's failure to properly dispose of refuse and garbage, properly recycle or other violation of law. 39. Attorney Fees: Tenant understands and agrees, tenant will be responsible for the landlord cost and the attorney fees associated with the breach of this lease agreement and or landlord collection cost of unpaid rent. 40.False Application: Application Information: Tenant's lease application (the Application) is incorporated by reference and made a part of this Lease. Tenant represents that the information on the Application is true and accurate. Tenant understands and agrees that Landlord has relied on the Application in order to determine whether or not to offer this Lease to Tenant.
